Terms of service

Agreement
By creating an account or using FormSMTP (the “service”), you agree to these terms and to our privacy policy and acceptable use policy. If you use FormSMTP for an organization, you accept these terms on its behalf.
The service
FormSMTP receives requests from your websites and apps and sends email through the SMTP account you connect. We don’t operate the SMTP server, so delivery to the recipient’s inbox also depends on your provider, your domain’s DNS settings and the recipient’s mail server. A “sent” status means your SMTP server accepted the message.
Your account
You must be at least 16 and give accurate information. Keep your password and API keys secure; you are responsible for activity under your account and keys. Tell us promptly at hello@formsmtp.com if you suspect unauthorized use.
Acceptable use
You must follow the acceptable use policy, your SMTP provider’s terms, and anti-spam and privacy laws that apply to you (such as CAN-SPAM, GDPR and India’s IT and data protection laws). In short: only email people who expect it, and never use FormSMTP for spam, phishing or malware.
Your content
You own your templates, contacts and the emails you send. You give us the permission needed to store and process them only to provide the service. You confirm you have the right to use the contact data you upload and to email those people.
Plans & payment
Plans and limits are described on the pricing page. The founding member plan is a limited-time offer for the first 2,000 accounts and is free forever for those accounts, subject to these terms (an account closed for breaking them loses it). Paid plans are billed in advance through Razorpay, monthly or yearly, and renew automatically until cancelled. You can cancel any time from your account and keep the plan until the end of the period you paid for; we don’t give refunds for partial periods unless the law requires it. Prices may include or exclude taxes as shown at checkout. We’ll give at least 30 days’ notice of price changes for existing subscriptions.
Availability
We work hard to keep FormSMTP running, but we provide it “as is” without guarantees of uninterrupted availability. We may change or discontinue features; for significant changes we’ll give reasonable notice.
Liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability is limited to the amount you paid us in the 12 months before the claim (or USD 50 if you use a free plan). Nothing in these terms limits liability that cannot be limited by law.
Ending the agreement
You can delete your account at any time. We may suspend or close accounts that break these terms or the acceptable use policy, or that put the service or others at risk. Where reasonable, we’ll warn you first.
Governing law
These terms are governed by the laws of India, without regard to conflict-of-law rules, and courts in India have jurisdiction, unless the law where you live gives you the right to bring claims there.
